Definition of "Marital Deduction"

Provision in the federal estate and gift tax law allowing all the assets of a marriage partner to pass to the surviving spouse free of estate taxes

A provision of the Federal Tax Code that provides an unlimited deduction from Federal Estate Taxes to qualified transfers of property between a husband and wife. This in effect can shift the estate tax burden to the last spouse's death.
